1. Order Acceptance & Contract Formation

Confirmation Required: A binding contract (overeenkomst) is only formed when we explicitly accept your order by sending you a formal confirmation email. We reserve the right to decline any order for any reason.
Pricing and Errors: We make every effort to ensure pricing on this website is accurate. However, obvious errors or mistakes (kennelijke vergissingen) are not legally binding. If we discover an error, we will inform you as soon as possible to reconfirm or cancel the order.
Estimated Turnaround: Any turnaround or delivery times stated on our website or during initial correspondence are strictly estimates and do not constitute a strict deadline (fatale termijn).
Service-Specific Terms: The terms outlined on this website are general guidelines. 2. Payment & Cancellation

Payment Terms: Unless otherwise agreed in writing, all invoices must be paid within 14 days of the invoice date.
Late Payment: If payment is not received within 14 days, you will be considered in default (verzuim) automatically without the need for a further formal notice. We reserve the right to charge statutory interest (wettelijke rente) and collection costs on overdue amounts.
Cancellation by You: If you wish to cancel or modify your order, you must notify us in writing immediately. Deposits are non-refundable once work has commenced or resources have been allocated to your project.
Cancellation by Us: We reserve the right to suspend work or terminate the agreement if you fail to provide necessary information, miss payment deadlines, or breach these terms.
3. Intellectual Property Rights
Our Content: All content, designs, text, layout, graphics, images, and project case studies displayed on this website are the intellectual property of Brenda Works and are protected by Dutch copyright law (Auteurswet). You may not copy, reproduce, or redistribute any content without our express written permission.
Portfolio Display Rights: Unless explicitly agreed otherwise in writing before work begins, we retain the right to showcase any completed work, custom designs, or project outcomes resulting from your order in our online portfolio, social media, and marketing materials.

4. Limitation of Liability

Website Availability: While we strive to keep this website functional, we do not guarantee uninterrupted access. We are not liable if the website is temporarily unavailable or if your form submission fails to reach us due to technical issues.
Cap on Liability: Except in cases of intent (opzet) or deliberate recklessness (bewuste roekeloosheid), our total financial liability to you for any claim arising out of an order or the use of this website shall be strictly limited to the total amount paid by you to us for that specific order.
Exclusion of Indirect Losses: We shall not be liable for any indirect, incidental, or consequential losses, including but not limited to loss of profits, loss of business, or loss of data.
